Terms of Service

1. Acceptance of Terms

By accessing or using Upmyth, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including administrators, agents, and any other personnel accessing a workspace.

2. Platform Access

Upmyth grants you a limited, non-exclusive, non-transferable right to access and use the platform for your internal business purposes. Each workspace is accessed by authenticated users only.

3. Acceptable Use

You agree not to:

• Use the platform to send spam, unsolicited messages, or violate Meta's WhatsApp Business Policy
• Reverse-engineer, copy, or redistribute any part of the platform
• Attempt to gain unauthorised access to any workspace or infrastructure
• Use the platform for any unlawful purpose

4. Subscriptions and Billing

Access to paid features requires an active subscription. Trial workspaces are provided free of charge for 14 days. After the trial, continued access requires a paid plan. We reserve the right to suspend accounts with overdue payments after a reasonable notice period.

5. Data Ownership

You retain full ownership of all data you upload or create within your workspace. Upmyth does not claim any ownership over your leads, contacts, or messages. We process your data only as a data processor acting on your instructions.

6. WhatsApp / Meta Compliance

You are responsible for ensuring that your use of WhatsApp Business features through Upmyth complies with Meta's Business Policy and applicable laws. Sending promotional messages to users who have not opted in may result in suspension of your WhatsApp number by Meta.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible.

8. Limitation of Liability

Upmyth shall not be liable for indirect, incidental, or consequential damages arising from your use of the platform. Our liability is limited to the amount paid by you in the three months preceding the claim.

9. Termination

Either party may terminate the subscription at any time. On termination, your workspace will be deactivated and data retained per our privacy policy.

10. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
